A number of companies, like Cannabix Technologies and Hound Labs, are in the process of developing breath detection devices. Tara Lovestead is providing the data that will help relate the concentration of THC detected in the breath to what's in the blood. Even though blood provides an incomplete and indirect inkling of what's happening in the brain, it's the measure law enforcement turns to as a benchmark.


ODAPC and the DOT Office of General Counsel (OGC) provide written interpretations of the provisions of this part. These written DOT interpretations are the only official and authoritative interpretations concerning the provisions of this part. DOT agencies may incorporate ODAPC/OGC interpretations in written guidance they issue concerning drug and alcohol testing matters. Only Part 40 interpretations issued after August 1, 2001, are considered valid.




Scientists Detect Drug Use By Testing One’s Breath




No, as an employer, you must not require an employee to sign a consent, release, waiver of liability, or indemnification agreement with respect to any part of the drug or alcohol testing process covered by this part (including, but not limited to, collections, laboratory testing, MRO and SAP services).


As a laboratory, you must permit an inspection, with or without prior notice, by ODAPC, a DOT agency, or a DOT-regulated employer that contracts with the laboratory for drug testing under the DOT drug testing program, or the designee of such an employer.


No. Drug tests other than on urine specimens are not authorized for testing under this part. Only urine specimens screened and confirmed at HHS certified laboratories (see 40.81) are allowed for drug testing under this part. Point-of-collection urine testing or instant tests are not authorized.


No, other types of alcohol tests (e,g., blood and urine) are not authorized for testing done under this part. Only saliva or breath for screening tests and breath for confirmation tests using approved devices are permitted.


Except as otherwise provided in this subpart, as a service agent or employer participating in the DOT drug or alcohol testing process, you are prohibited from releasing individual test results or medical information about an employee to third parties without the employee's specific written consent.


This section is a subset of Toxicology and supports NYSP's Traffic Services Breath Testing Program by performing the maintenance, repairs and certification of the State Police's Draeger 9510 breath testing equipment. They also support the breath testing programs through the certification of reference materials (simulator solution and reference gas) used by law enforcement agencies statewide and provide expert testimony on alcohol-related matters.


The Evidential Breath Alcohol Testing (EBAT) program repairs, calibrates and certifies the Intoxilyzer 9000 (I-9000) instruments used statewide to test subjects suspected of driving under the influence of alcohol. The EBAT program also trains and certifies law enforcement officers who perform these tests using the I-9000. The EBAT Program has established rigorous scientific standards of performance that every Intoxilyzer 9000 used for evidential breath alcohol testing must meet prior to being certified by the department and placed into service. The testing performed on the instruments prior to certification ensures that the results reported by the instruments are at the highest possible level of scientific accuracy, precision and fairness. The EBAT Program is accredited by the ANSI National Accreditation Board (ANAB) and meets the ISO/IEC 17025:2017 Forensic Science Calibration Laboratories Accreditation Requirements.
